Terms of Service

1. Acceptance

By creating an Everyframe account, installing the Everyframe Chrome extension, or using the Everyframe website or rendering service ("the service"), you agree to these terms. If you do not agree, do not use the service.

The service is operated by Ross Shannon, a sole trader based in Dublin, Ireland, with registered operating address [OPERATOR_ADDRESS] ("we", "us", "our").

2. Service description

Everyframe takes a still portrait that you upload and produces a short MP4 video — typically about three seconds in length — in which the subject of the portrait moves. The animation is generated by a GPU model (LivePortrait) hosted on Modal.

The service is delivered via the Everyframe website and the Everyframe Chrome extension. Authentication is provided by Clerk and billing is provided by Stripe.

3. Your account

You must be at least 18 years old to create an account. You agree to provide accurate information and to keep it up to date.

You may hold one account per person. You are responsible for all activity that takes place under your account, including any use of API keys or extension tokens issued to you. Keep your credentials secure and notify us promptly at [email protected] if you suspect unauthorised access.

4. Acceptable use

When you submit an image to Everyframe you confirm all of the following:

You are solely responsible for the consent you have obtained from the people depicted in any image you submit. If asked, you must be able to demonstrate that consent.

5. Output ownership and licence

You keep ownership of the images you submit and of the MP4s the service generates from them.

You grant us a limited, worldwide, non-exclusive, royalty-free licence to receive, process, animate, and return your image for the sole purpose of producing the output you have requested. The licence ends when the response has been delivered.

We do not retain the source image or the generated MP4 after the response is delivered, and we do not use either to train models. We do retain the audit-log information described in our Privacy Policy.

6. Refusal and enforcement

We may refuse any submission, with or without reason, including any submission flagged by our content moderation classifier. Refused submissions do not consume credits and are not billed.

We may suspend or terminate any account that breaches these terms, and we may report unlawful conduct to the relevant authorities. Where the breach is severe — for example animating identifiable people without consent, or attempting to generate prohibited content — suspension may be immediate and without notice.

7. Subscription terms

Everyframe offers a free tier of 5 renders per month and a paid tier of 100 renders per month for €15 (or local equivalent), billed monthly via Stripe. Pricing is shown on the pricing page and is the authoritative source of current prices.

Paid subscriptions renew automatically each month until cancelled. You can cancel at any time from your dashboard by selecting "Manage billing", which opens the Stripe-hosted billing portal.

When you cancel, your plan stays active until the end of the current billing period. We do not provide pro-rated refunds for unused renders within a period.

Unused renders do not carry over to the following month. Free-tier credits reset on the first day of each calendar month. Paid-tier credits reset on each billing-period anniversary.

If a payment fails, we will retry the charge in line with Stripe's default retry schedule. If payment cannot be collected we may downgrade your account to the free tier.

8. Service availability

Everyframe is a beta product. We do not commit to any specific uptime or render latency. Planned maintenance, model upgrades, and capacity issues at our subprocessors may cause temporary outages.

We will make reasonable efforts to keep the service available and to communicate significant outages.

9. Disclaimers

The service is provided on an "as is" and "as available" basis. We do not warrant that the output will meet your expectations, that the service will be uninterrupted or error-free, or that defects will be corrected within any specific timeframe.

To the fullest extent permitted by law, we disclaim all implied warranties, including the implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, and non-infringement. Animation output is generated by a probabilistic model and may contain visual artefacts, distortions, or unintended likenesses.

10. Limitation of liability

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the service is limited to the total fees you have paid to us in the twelve months immediately before the event giving rise to the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, even if we have been advised of the possibility of such damages.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under Irish law.

11. Indemnification

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of: your breach of these terms; your misuse of the service; or your submission of any image without the necessary rights or consent. This includes any claim brought by a person depicted in an image you submitted without their consent.

12. Termination

You may terminate your account at any time by cancelling your subscription and asking us to delete your account at [email protected].

We may terminate or suspend your account if you breach these terms, if we are required to by law, or if we discontinue the service. Where reasonably possible we will give you prior notice.

On termination your right to use the service ends immediately. We retain anonymised audit-log entries for the purposes described in the Privacy Policy. The sections of these terms that by their nature should survive termination — including sections 5, 9, 10, 11, 13, and 14 — will survive.

13. Governing law

These terms and any dispute arising from them are governed by the laws of Ireland.

14. Disputes

Any dispute arising out of or in connection with these terms, including disputes about their existence, validity, or termination, is subject to the exclusive jurisdiction of the courts of Ireland.

Nothing in this section affects any non-waivable right you have as a consumer to bring proceedings in the courts of your country of residence.

15. Changes to these terms

We may update these terms from time to time. For material changes we will notify registered users by email at least 14 days before the change takes effect. Continued use of the service after the effective date of the change constitutes acceptance of the updated terms.

If you do not accept a change, you should stop using the service and cancel your subscription before the change takes effect.
